Welcome to Obsera. By using our mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
1. Nature of Service & No Medical Advice
Obsera is an AI-powered pattern analysis tool designed to provide objective insights into interpersonal dynamics for informational and self-reflection purposes only.
- Not Medical or Psychological Advice: Obsera does not provide medical, psychiatric, or psychological diagnosis, treatment, or clinical advice.
- No Clinical Relationship: Use of Obsera does not create a clinician-patient or therapist-client relationship.
- Not a Replacement for Professionals: This tool is not a substitute for professional therapy, counseling, or medical intervention.
- Emergency & Crisis Support: Obsera is not intended for use in medical or mental health emergencies. If you are experiencing a mental health crisis, emotional distress, or are in an abusive or unsafe situation, please seek immediate help from a licensed professional or emergency services.
2. Eligibility
You must be at least 18 years of age to use Obsera. By using the App, you represent and warrant that you meet this age requirement.
3. Account & Security
- Sign in with Apple: We use Sign in with Apple for authentication. You are responsible for maintaining the security of your Apple account.
- User Data: Your chat history and subject profiles are stored locally on your device. You are responsible for any data loss occurring if the App is deleted or your device is reset.
4. Subscriptions & Payments
- Obsera Pro: Certain features require an active subscription ("Obsera Pro").
- Billing: All payments are handled via the Apple App Store (StoreKit). Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Refunds: All refund requests must be processed through Apple. Obsera cannot issue refunds directly.
5. Acceptable Use & Restrictions
You agree NOT to use Obsera to:
- Engage in illegal activities or harass, abuse, or threaten others.
- Upload content that is defamatory, obscene, or violates the privacy of others.
- Reverse engineer or attempt to extract the source code of the App or its underlying AI models.
- Misrepresent AI-generated insights as expert medical or legal advice.
6. Intellectual Property
- Our Content: The App's design, logos, clinical logic, and proprietary prompts are the property of Cerebra Solutions LLC.
- AI-Generated Insights: You are granted a personal, non-exclusive license to use the insights generated by Obsera for your own personal reflection.
7. Disclaimers & Limitation of Liability
- "As Is" Basis: Obsera is provided "as is" and "as available" without warranties of any kind, express or implied.
- AI Inaccuracy: AI-generated insights may be inaccurate, incomplete, or biased. We do not guarantee the accuracy of any analysis provided.
- Limitation of Liability: To the maximum extent permitted by law, Cerebra Solutions LLC and its developers shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App or reliance on its insights.
8. Changes to Terms
We may update these Terms of Service at any time. Your continued use of the App following any changes constitutes your acceptance of the new Terms.
9. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
